You should carefully read the following Terms and Conditions. Your use of our products implies that you have read and accepted these Terms and Conditions.

You can download any of our free products, the free web templates, from MAGICORE and use it for your website free of charge with the exception of images or pictures. You must replace the images or pictures of your own as they are copyrighted by other entities. You are authorized to make any necessary modification(s) to our free web templates to fit your purposes. However, you do not have rights to resell/license/sub license/lease the web templates derived from our free templates in their modified or present forms under any circumstances. You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. Make sure you read and comply with the license info if included into the download package.

MAGICORE should provide no support and no service for our free products, the free web templates. MAGICORE will, however, provide separate service contract for paid products.

MAGICORE's products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall MAGICORE be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products or our services.

DAMAGES LIMITATION. LIABILITY ARISING UNDER THESE TERMS OF USE SHALL BE LIMITED TO DIRECT, OBJECTIVELY MEASURABLE DAMAGES. NEITHER PARTY OR THEIR SUPPLIERS, INCLUDING YOUR VENDORS, CUSTOMERS OR USERS, SHALL HAVE ANY LIABLITY TO THE OTHER PARTY OR TO ANY THIRD PARTY, FOR ANY INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, INTERRUPTION OF BUSINESS, OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES FROM USE OF MAGICORE'S PRODUCTS AND/OR SOLUTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE) STRICTIBILITY OR OTHERWISE.

Notwithstanding anything to the contrary, the aggregate liability of MAGICORE and its related companies under these Terms of Use shall not exceed the total amounts paid by you to MAGICORE hereunder during the usage of MAGICORE's product or solution. You hereby agree and acknowledge that MAGICORE is not responsible for interruption of services due to use of MAGICORE's product and/or solution.

SOLE REMEDIES: MATERIALITY. MAGICORE AND ITS RELATED COMPANIES DISCLAIM ANY AND ALL LIABILITIES OR DAMAGES AND AGREES THAT THE LIABILITY OF MAGICORE AND ITS COMPANIES ARISING UNDER THIS AGREEMENT OR IN CONNECTION WITH THE SERVICES SHALL BE EXPRESSLY LIMITED TO THE LIABILITY AND DAMAGES PROVIDED HEREIN. THE PARTIES ACKNOWLEDGE THAT THE LIMITATIONS REFERENCED IN THIS SECTION ARE MATERIAL TERMS TO THIS AGREEMENT.

UPON USING OUR FREE PRODUCTS, THE FREE WEB TEMPLATES, I AGREE TO BE BOUND BY ALL THE TERMS IN THIS AGREEMENT.

MAGICORE reserves the right to change or modify these terms and rules with no prior notice.
